Refund Policy

Effective Date: November 5, 2025

At GSTechnologies Limited (“the Company”), we are committed to delivering high-quality, professional IT and information services in accordance with industry standards and the expectations set forth in our agreements. This Refund Policy is formulated in compliance with the applicable laws of the Hong Kong Special Administrative Region (HKSAR), including the Supply of Services (Implied Terms) Ordinance (Cap. 457) and other relevant consumer protection principles under Hong Kong law.

1. General Principle

The services provided by GSTechnologies Limited are customised, professional, and rendered based on mutually agreed scope, specifications, timelines, and pricing as documented in a signed Statement of Work (SOW), proposal, or service agreement. Due to the bespoke and non-tangible nature of these services, refunds are not automatically granted and are subject to the conditions below and the terms of the underlying contract.

2. Refund Eligibility Under Hong Kong Law

  1. a) Cancellation Before Commencement of Services
  • If a Client cancels an order before any work has commenced and prior to the agreed start date, and no third-party costs have been incurred, the Company will refund any advance payment made, less any reasonable administrative costs (not exceeding 10% of the deposit).
  • Refunds will be processed within 14 business days of written cancellation notice.
  1. b) Cancellation After Services Have Commenced
  • Once work has begun (including planning, analysis, development, or deployment), the Client remains liable for all fees attributable to services performed and costs incurred up to the date of cancellation, in accordance with Section 6 of the Supply of Services (Implied Terms) Ordinance (Cap. 457).
  • No refund will be issued for completed or partially performed services that conform to the agreed scope.
  • Any unused prepaid amounts for future phases may be considered for refund at the Company’s discretion, less a reasonable charge for administration and committed resources (minimum 15%).
  1. c) Subscription or Recurring Services
  • For ongoing services (e.g., cloud management, cybersecurity monitoring, or support plans), fees are payable in advance for each billing cycle.
  • Clients may terminate such services with 30 days’ written notice, but no refund will be issued for the current paid period, as services are deemed rendered progressively over time.
  1. d) Failure to Provide Services with Reasonable Care and Skill
  • Under Hong Kong law, the Company is required to perform services with reasonable care and skill (Cap. 457, Section 5).
  • If a deliverable materially fails to meet this standard and the agreed specifications in the SOW, the Client must notify the Company in writing within 10 business days of delivery.
  • Upon verification, the Company will, at its option:
    (i) re-perform the defective part of the service at no additional cost; or
    (ii) if re-performance is not feasible and the failure constitutes a material breach, issue a proportionate refund reflecting the value of the non-conforming portion.
  • Refunds will not apply to minor discrepancies, subjective dissatisfaction, delays caused by the Client, or issues arising from Client-provided systems, data, or third-party dependencies.

3. Non-Refundable Items

The following items are non-refundable under Hong Kong law once incurred or activated:

  • Third-party expenses (e.g., software licenses, cloud hosting fees, domain registrations, SaaS subscriptions);
  • Fees for completed consulting sessions, workshops, audits, or advisory services.

4. Refund Request Procedure

  • All refund requests must be submitted in writing to info@gsctechno.com with:
    (i) reference to the project or invoice number;
    (ii) clear description of the issue; and
    (iii) supporting evidence (if applicable).
  • The Company will respond within 10 business days and, if approved, process the refund within 14–30 business days via the original payment method or bank transfer.

5. Discretionary Goodwill Adjustments

The Company may, at its sole discretion and without admission of liability, offer account credits, service extensions, or partial refunds as a gesture of goodwill – even where not legally required – based on the circumstances and the Client’s relationship with the Company.

6. Governing Law and Jurisdiction

This Refund Policy is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from this policy or related services shall be subject to the exclusive jurisdiction of the Hong Kong courts.
